Section 40
Miscellaneous Goods

(1) Goods that are physically integrated with other goods in such a way as to lose their identity in the product or group thereof will be mixed goods. (2) The right of mortgage may not be created on the mixed goods. (3) If the mortgage property is mixed goods, the mortgage right will be attached to its product or group. (4) If the mortgage right on the mortgage property matures before the mortgage property is mixed goods, the mortgage right associated with the product or group may mature even if the notice is not registered. . The priority of mortgage rights over the product or group thereof shall be calculated from the time of maturity of the mortgage right over the mixed mortgage property. (5) When more than one mortgage right is attached to the product or group of mixed goods, the priority shall be determined as follows:- (a) When the mortgage property is mixed goods. A matured security right shall have priority over a then unmatured security right, (b) a first security right belonging to a product or a group thereof shall have priority over an unmature security right, and (c) if more than one security right has matured, in proportion to the value of the security asset when the security asset is a mixed asset. The mortgage rights will remain in the same position.
